1. Acceptance of Terms

By creating an account, purchasing a course, or enrolling in any free program on our platform, you confirm that you are at least 18 years old (or have parental/legal guardian consent) and that you agree to these Terms. If you do not agree, please do not use our services.

2. Account Registration

To access most of our courses and tools, you must register for an account.

You agree to provide accurate, current, and complete information during registration.

You are responsible for safeguarding your password and for any activities or actions under your account.

3. Types of Courses and Services Offered

We offer the following categories of services and language courses on our platform:

Self-Led Courses: Fully automated, self-paced courses where access to materials is digital, and no live tutoring or individual evaluation by a teacher is included unless explicitly stated.

Instructor-Led Courses: Live, interactive sessions with a qualified instructor. Designed for active practice, they do not require homework, assignments, or out-of-class study unless explicitly specified in the course description.

Blended Courses: A combination of fully automated, self-paced digital materials with scheduled live sessions or periodic evaluations by an instructor. The exact balance between independent study and live interaction.

Free Placement and Level Tests: Complimentary assessment tools designed to evaluate your current language skills. We reserve the right to make these tests mandatory before allowing enrollment in specific Self-Led, Instructor-Led, or Blended Courses, ensuring students register for the appropriate level. These tests are provided for informational and placement purposes and do not constitute an official language certificate.

On-Demand Additional Services (Tutoring & Extra Live Classes): Optional on-demand services that can be purchased separately, such as private tutoring, individual live sessions, or customised exam preparation. These services are subject to availability.

4. Updates and Modifications to Course Content

We are committed to providing high-quality language education. To ensure our materials remain accurate, current, and effective, we reserve the right to update, modify, add, or remove content (including text, videos, exercises, and structure) from any course at any time, even if you are currently enrolled in it. These dynamic updates are designed to enhance your learning experience, and they do not entitle you to a refund, compensation, or access to previous versions of the content.

5. Pricing, Free Content, and Payments

Free Courses and Tests: We offer complimentary placement tests and may offer free courses or trial lessons. We reserve the right to modify or withdraw access to any free content at any time without prior notice.

Paid Courses: Prices for paid courses are displayed on our website. We reserve the right to change prices at any time; however, price changes will not affect courses you have already purchased or enrollments that have already been confirmed. We also reserve the right to cancel orders or enrollments resulting from obvious pricing errors or system glitches on the website..

Payment Processing: All paid transactions are processed securely through WooCommerce and its integrated third-party payment gateways (e.g., Stripe, PayPal). We do not store your credit card details on our servers.

Course Validity and Expiration: Access to purchased courses is limited to the duration specified in the course description at the time of purchase (e.g., 3 months, 12 months, or subscription-based). Once this period expires, access to the course materials and/or live sessions will be automatically deactivated.

6. Right of Withdrawal and Refund Policy

You have the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 days from the day of the conclusion of the contract (the date of purchase)..

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement sent by email to info@helloglot.com. You may use the model withdrawal form provided at the end of these Terms, but it is not obligatory.

6.1. Exceptions to the Right of Withdrawal

Self-Led Courses (Digital Content): In accordance with EU consumer law, your 14-day right of withdrawal for digital content that is not supplied on a tangible medium is waived and lost once the performance has begun. By purchasing a Self-Led Course, ticking the consent box at checkout, and logging in to access, stream, or download the course materials, you expressly agree to immediate performance and acknowledge that you lose your right of withdrawal.

Instructor-Led Courses (Service Contracts): If you enroll in an Instructor-Led Course, you have a statutory right to withdraw within 14 days of purchase. By enrolling, you agree that the course schedule and live sessions will begin automatically. If you decide to withdraw during this 14-day period, you will be liable to pay an amount proportional to the live sessions or tutoring already conducted up until the moment you formally notify us of your withdrawal. If the course or live sessions are fully completed within these 14 days, your right of withdrawal is completely lost.

Blended Courses: These courses combine digital content and live sessions. Your right of withdrawal for the self-paced digital portion of the course is waived and lost once you log in to access, stream, or download those materials (as per the Self-Led Courses policy). If you choose to withdraw within the 14-day period after accessing the digital materials but before all live sessions have been completed, any eligible refund will be calculated proportionally, deducting both the value of the accessed digital content and the cost of any live sessions or evaluations already conducted

On-Demand Additional Services (Tutoring & Extra Live Classes): If you purchase additional, on-demand services (such as private tutoring, individual live sessions, or custom exam preparation) and expressly request them to begin during your 14-day withdrawal period, you will be liable to pay for the sessions already conducted up until you inform us of your cancellation. If these requested on-demand services are fully performed within the 14 days (e.g., a fully completed private tutoring pack), your right of withdrawal for that specific service is completely lost.

6.2. Effects of Withdrawal

If you validly withdraw from a contract under this section, we will reimburse all payments received from you for that specific course or service (subject to the deductions detailed in Section 6.1) without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

7. Course Cancellation and Rescheduling by Helloglot

We strive to deliver all scheduled courses as planned. However, Helloglot reserves the right to cancel, postpone, or alter scheduled Instructor-Led, Blended, or On-Demand live classes under the following specific circumstances.

7.1. Minimum Enrollment Threshold and Group Maintenance

Group courses (Instructor-Led or Blended) require a minimum capacity of at least 70% of the offered places to ensure a viable learning environment and group dynamic. Helloglot reserves the right to cancel or alter a course under the following conditions:

1. Cancellation Prior to Start Date: If total enrollments do not reach the 70% threshold before the course start date, Helloglot may cancel or postpone the course. Affected students will be notified via email at least 48–72 hours in advance and will be offered either a full 100% refund or the option to transfer their enrollment to an alternative available course/schedule of equivalent value.

2. Cancellation After Commencement: If a course starts but active student participation falls below the required threshold (e.g., due to statutory 14-day withdrawals by other participants), Helloglot reserves the right to discontinue the group. In such events, remaining students will receive a proportional refund strictly corresponding to the unconducted sessions, or may be offered an adapted service (e.g., equivalent value in reduced private/semi-private sessions) upon mutual agreement.

7.2. Force Majeure and Instructor Unavailability

In the event of unforeseen circumstances beyond our reasonable control—including but not limited to severe instructor illness, technical infrastructure outages, emergencies, or legal/regulatory events—Helloglot reserves the right to cancel or reschedule specific live sessions or the full course. In the case of individual class cancellations, Helloglot will make reasonable efforts to offer a substitute teacher or reschedule the missed session. If the missed session cannot be rescheduled or substituted, Helloglot will issue a proportional refund for that specific session.. If a full course must be canceled mid-term, a proportional refund for the remaining unperformed sessions will be issued.

7.3. Student Incompatibility or Misalignment with Mandatory Level Requirements

If a student enrolls in an Instructor-Led or Blended course without meeting required prerequisites or completing a mandatory placement test, and it becomes evident that their language level severely hinders the learning progression of the group, Helloglot reserves the right to cancel that student’s participation in that specific group. In such cases, Helloglot will attempt to offer an alternative course matching the student’s actual level or issue a full/proportional refund..

7.4. Manifest Errors in Pricing or Course Information

If a course is listed or purchased at an incorrect price due to a system malfunction, typographical error, or IT fault, Helloglot reserves the right to cancel the enrollment. The affected user will receive a full refund of any amount paid..

7.5. Limitation of Compensation

In all cases of cancellation or rescheduling initiated by Helloglot, our maximum liability is strictly limited to offering an alternative course option or issuing a full or proportional refund of the amount paid for the affected service. Helloglot shall not be held liable for any indirect costs, third-party software purchases, hardware upgrades, internet connection fees, or any other consequential damages incurred by the user.

8. Intellectual Property Rights

All content included in our courses and tools (including text, questions, and structure of the placement tests, videos, graphics, logos, audio clips, and quizzes) is the property of Helloglot or its content suppliers and is protected by international copyright laws.

Your purchase or enrollment grants you a limited, personal, non-transferable license to access the materials for your personal learning.

You may not share your account log-in, resell, distribute, copy, or publicly display any of our course or test materials.

9. Code of Conduct (For Live Classes and Forums)

When participating in live classes or community forums, you agree to behave respectfully. We do not tolerate harassment, abusive language, discrimination, or disruptive behavior. We reserve the right to terminate your access to the platform immediately, without a refund, if you violate this code of conduct.

10. Limitation of Liability

Our courses, digital materials, and placement tests are provided “as is” without any warranty of any kind, either express or implied. While we strive to provide high-quality language education, we do not guarantee specific results, such as passing official exams or reaching specific fluency levels. Furthermore, while our placement tests are designed to recommend the most suitable learning path, we do not guarantee that the recommended level will perfectly match your personal expectations, and we are not liable for any dissatisfaction regarding the recommended or chosen course level.

We are not liable for any indirect, incidental, or consequential damages resulting from your use of our platform. Additionally, we are not responsible for any technical failures, interruptions, or service disruptions caused by third-party software or platforms used to deliver our live sessions (such as Zoom, Google Meet, or similar services).

You are solely responsible for ensuring you meet the minimum technical requirements to access our platform, digital materials, and live classes, including a stable internet connection, a compatible web browser, and operational audio/video hardware.

11. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the website after changes are posted constitutes your acceptance of the new Terms.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Catalonia and Spain, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of your place of residence if you are a consumer.
